Understanding Labour Relations

Presented by the Employer Representation in Recourse team within the Office of the Chief Human Resources Officer at the Treasury Board of Canada Secretariat, this series on disciplinary and non-disciplinary matters in labour relations allows analysts to enhance their skills and knowledge in this field.

The series is made up of four independent sessions:

These sessions have been designed for labour relations specialists. They are offered at no cost, in Ottawa or by webcast.

Session 1: Non-disciplinary Actions and Issues—Unsatisfactory Performance

This session will be an opportunity to explore the different types of behaviour associated with unsatisfactory performance and possible solutions. Facilitators will present the guidelines for identifying unsatisfactory performance and the legislative framework that outlines the measures to take. They will also address non-disciplinary questions and related jurisprudence.

Session 2: Non-disciplinary Terminations, Demotions and Probation

Past Event

This session will allow participants to become familiar with the principles governing non disciplinary termination and demotions, which are issued for reasons such as medical incapacity, the duty to accommodate, security clearance or reliability status and others. The probationary period will also be discussed as well as relevant jurisprudence.

Session 3: Disciplinary Measures (Legal Framework and Basic Principles)

This session will review the legal and disciplinary framework surrounding labour relations. Facilitators will address subjects like procedural fairness and natural justice, progressive discipline, burden of proof and standard of proof, culpable and non-culpable behaviour and insubordination. Related jurisprudence will be presented.

Session 4: Disciplinary Measures (Administrative Investigation, Disciplinary Process and Other Related Topics)

This session will address administrative investigations into misconduct, the disciplinary process, the letter of discipline, double jeopardy, multiple acts of misconduct, off-duty misconduct, disciplinary measures as well as reliability status and security clearance. There will also be discussion of the immunity of unions and reintegration to work following a third-party decision. Related jurisprudence will be presented.
